Terms and Conditions: COS Membership

1. INTRODUCTION 

 

1.1 Welcome to the COS Membership Program. The following terms and conditions (“Membership Terms”) are valid between you and H & M Hennes & Mauritz GBC AB (reg. no. 556070-1715) hereinafter referred to as "COS", "us" or "we". 

 

1.2 By registering for an account, you become a COS Member, and you confirm that you have read and agree to be bound by these Membership Terms. Please ensure you have also read and understand our Privacy Policy before accepting the Membership Terms. 

 

1.3 The COS Membership Program is free of charge and no purchase is necessary to become a member.

2. MEMBERSHIP 

 

2.1 By becoming a COS Member, you will have a chance to enjoy early access to promotions and collections, exclusive offers, and more. 

 

2.2 The membership is limited to individuals that are acting in a personal capacity and not in the capacity of a company, who have a current and valid email account and are considered to be an adult by local legislation in the applicable province or territory of residence, or from 16 years of age who have the consent of the parent(s), guardian or legal representative as applicable. COS reserves the right to request written confirmation of such consent. Employees, officers, directors, agents, and representatives of COS are eligible for membership but may be excluded from certain promotions. 

 

2.3 Your membership is personal, non-transferable, and subject to these Membership Terms as well as any other rules, regulations, policies, and procedures adopted by COS as approved by you upon taking part in offers, rewards, making purchases and other related services. We apply a limit of one membership per person and registered email address. 

 

2.4 Companies, groups, associations or other entities, or others making commercial or bulk purchases, are not eligible for membership. The membership shall not be used for reselling or profit. 

 

2.5 We only allow one (1) registered account per email address. It is your responsibility, and a condition for your membership, to keep your email address and contact details up to date. Your account will be available from the time you receive a confirmation that the account has been successfully registered. 

 

2.6 You are responsible for all activity that is conducted through your COS Membership account. This means that you are also responsible for making every effort to keep your login details, such as email address and other authentication steps, secure and private. If your account is compromised, we advise you to quickly reach out to Customer Service for further assistance. 

3. CHANGES, TERMINATION AND/OR REMOVAL FROM COS MEMBERSHIP 

 

3.1 You may cancel your membership at any time through My Account on the website cos.com or by contacting COS Customer Service. By cancelling your membership, you can only use the guest check-out option when shopping online. 

 

3.2 COS may, at its sole discretion, terminate, alter, limit, suspend or modify the Membership and/or the Membership Terms at any time, in case of changes to applicable laws, changes in services provided by COS or introducing new services. Any such change will take effect after 14 days from the date on which you have been informed of such change either in My Account, on cos.com, via email or a combination thereof. If you do not accept the changes, you have the right to cancel your membership. 

 

3.3 COS reserves the right to make minor changes to the Membership and the Membership Terms without providing you with prior notification, provided that these changes do not materially affect the membership in a negative way. Please make sure to stay updated on the Membership Terms. You will always find the latest version of the Membership Terms on cos.com. 

 

3.4 Any violation of the Membership Terms, proven or probable fraud, non-compliance with the Membership Terms, inactivity on the account, provision of incorrect data or any act detrimental to COS’s interests may lead to termination of, and/or affect your ability to participate in, the COS Membership Program. 

 

3.5 We reserve the right to terminate or restrict access to accounts for the following reasons. Reasons for termination or restriction may include, but are not limited, to the following: (1) Abnormal, frequent and/or high number of returns; (2) Behaviour demonstrating clear intent to resell and/or make a profit by purchasing our products; or (3) Multiple accounts and/or registration of a new account by previously suspended users. We also reserve the right to cancel orders made when shopping as a guest for the same reasons. 4. LIMITATION OF LIABILITY 

 

4.1 COS will not be liable for any system failure or malfunction of the COS Membership Program or any consequences thereof. COS accepts no liability for any loss or damages arising from suspension, variation, or termination or in any other way relating to the COS Membership Program, except for any liability which cannot be excluded by law. 

5. APPLICABLE LAW AND JURISDICTION 

 

5.1 These Membership Terms shall be governed by the laws of Sweden, without regard to any rules or principles on conflict of laws. However, if you are resident in another country than Sweden, these Membership Terms can be subject to mandatory consumer protection laws and regulations in force in the country of residence, which may provide you with additional rights. Any dispute, claim or controversy arising from or relating to these Membership Terms, or your membership shall be resolved by the applicable courts in Sweden, unless otherwise stipulated in applicable mandatory laws of your country of residence. 

 

5.2 We adhere to applicable local dispute resolution regulations by competent authorities for the settlement of potential customer complaints. For more information, please see Customer Service

 

5.3 The invalidity or unenforceability of individual contractual provisions shall not affect the validity of the remaining contractual provisions. In such a case, the ineffective or unenforceable provision shall be replaced by the parties by an effective or practicable new provision.
